53-Year-Old Aussie Mom Convicted After Teen Boy Wakes to Sexual Assault in Party Tent
A 53-year-old female defendant is currently behind bars after an appellate court upheld a conviction in a sexual assault case against a teenage boy at a house party in rural South Australia.
Cynthia Frahn was reportedly found guilty of sexually assaulting a 15-year-old boy who had fallen asleep and was drunk in a tent at a house party at Cynthia’s residence in Monarto, near Adelaide, in June 2023.
The defendant was sentenced to a four-year prison term with a non-parole period of two years and six months.
The defendant has since appealed, seeking to overturn the original conviction and sentence, arguing that the case against her was flawed.
Cynthia’s legal team argued that a miscarriage of justice occurred because the judge misinterpreted DNA evidence presented in court, relying on what they termed “the prosecutor’s fallacy.”
The legal team argued that the defendant’s DNA evidence had been explained by “innocent transference in undisputed circumstances.”
However, this argument was not well taken by the appellate court judges.
Although the appellate court heard Cynthia’s case, it was dismissed, and her original conviction was upheld.
The appellate court panel argued that even though Cynthia’s case was not solely based on DNA evidence, it was still reasonable for the original judge to have found that “it was consistent with the verdict for the judge to find that the complainant was not willing and did not acquiesce in the applicant’s acts.”
Cynthia is currently behind bars after the appellate court dismissed her appeal.
